1. Scope of Application These Terms and Conditions apply to the rental of the vacation apartment for accommodation purposes, as well as all other services and deliveries provided to the guest by the landlord. Subletting or re-renting the provided apartment, as well as using it for purposes other than residential use, requires the prior written consent of the landlord. By making a booking, the guest accepts these Terms and Conditions.
2. Booking and Conclusion of Contract (1) The rental agreement is concluded when the landlord confirms the guest's booking request in writing or by email (booking confirmation) or once a down payment has been made by the guest. (2) The contracting parties are the landlord and the guest. If a third party has placed the order on behalf of the guest, they shall be jointly and severally liable to the landlord along with the guest. By booking, the guest declares that they are of legal age and act responsibly for all accompanying persons.
3. Payment Terms and Prices (1) The agreed prices are final prices and include the applicable statutory value-added tax (if applicable), as well as all utility costs (electricity, water, heating) and final cleaning. (2) Unless otherwise agreed, a down payment of 50% of the total price is due within 7 days of receiving the booking confirmation. The remaining balance must be paid no later than 14 days before the day of arrival without further request. (3) For short-term bookings (less than 14 days before arrival), the total price is due immediately.
4. Arrival and Departure (1) The vacation apartment is available to the guest from 3:00 PM on the agreed day of arrival. There is no entitlement to earlier availability. Deviating times are only possible by prior arrangement. (2) On the day of departure, the apartment must be vacated and left broom-clean by 11:00 AM at the latest. "Broom-clean" specifically means that the windows are closed, the dishes are washed and put away, the trash has been disposed of, and the refrigerator is emptied.
5. Use of the Vacation Apartment and House Rules (1) The vacation apartment may only be used by the number of persons specified in the booking. (2) Parties, commercial use, and events of any kind are strictly prohibited. (3) Smoking is not permitted inside the vacation apartment or on the balconies. (4) Pets are only allowed with the prior express written permission of the landlord. (5) The house rules published on the website and displayed in the vacation apartment are an integral part of the contract. By booking, the guest accepts these house rules as binding. In the event of gross violations of the house rules, the landlord is entitled to terminate the contract without notice. In this case, there is no entitlement to a refund of the rental costs. (6) The guest is liable for the loss of keys and remote controls.
6. Cancellation by the Guest (Cancellation Policy) We understand that plans can change and guests may wish to cancel their booking. Cancellation by the guest from the contract concluded with the landlord must be made in text form. In the event of a cancellation, the following cancellation fees apply:

Cancellation by the Landlord The landlord may withdraw from the contract before the start of the trip if fulfillment of the contract is rendered impossible due to force majeure, unforeseeable circumstances, or other reasons beyond the landlord's control. In this case, any payments already made will be fully refunded. Further claims are excluded.
8. Liability and Wi-Fi Usage (1) The landlord is liable for their obligations under the contract. Liability is limited to intent and gross negligence. No liability is assumed for items brought in by the guest. (2) The guest is liable for all damage to the vacation apartment and its inventory caused by them or their accompanying travelers. (3) The provided Wi-Fi access is intended for lawful use only. Copyright infringements (e.g., file-sharing) are prohibited. The guest indemnifies the landlord against all third-party claims resulting from misuse of the internet. The landlord assumes no guarantee for the actual availability or speed of the internet access. The guest is liable for violations committed during their period of use.
9. Data Protection Personal data will be processed exclusively within the framework of statutory provisions for the purpose of contract execution and to fulfill statutory reporting obligations. Further details can be found in the landlord's separate privacy policy.
10. Final Provisions (1) There is no statutory right of withdrawal for contracts concerning accommodation services (§ 312g para. 2 no. 9 BGB - German Civil Code). (2) German law applies. The place of jurisdiction is the residence of the landlord. (3) Should individual provisions of these T&Cs be or become invalid, this shall not affect the validity of the remaining provisions.
11. Tourist Tax (Kurtaxe) (1) The city of Bad Nauheim levies a tourist tax (Kurtaxe), which must be paid additionally in cash upon arrival. 12. Self Check-In (1) Check-in is contactless via a self-check-in system; the access codes will be sent to the tenant in due time before arrival after full payment of the rental price has been made. The tenant is obliged to contact the landlord immediately via the emergency number provided in the contract in the event of any access issues, to enable a prompt resolution.
